Lawyers for former French President Donald Trump have asked the judge to suspend the case against him for mishandling classified documents, pointing in their request to the Supreme Court's decision that the former president enjoys broad immunity from prosecution.
Special prosecutor Jack Smith has filed an indictment against Trump (78 years old) in Florida, accusing him of endangering national security by retaining highly confidential documents after leaving the White House, according to the French news agency.
In the lawsuit yesterday, Friday, Trump's lawyers asked Judge Aileen Cannon for a partial stay of proceedings to allow them to study the "implications" of the Supreme Court's decision on the Florida case.
Last Monday, the highest American courts ruled that the former president enjoys absolute immunity from criminal prosecution for "official acts" he performed while in office.
Trump, the Republican candidate for the presidential election next November, is asserting immunity in the four criminal cases he faces.
Trump was convicted in New York last May on 34 counts related to falsifying business records to cover up payments made to buy the silence of porn actress Stormy Daniels, who alleged that she had a sexual relationship with him.
Trump's lawyers immediately turned to the Supreme Court's decision to request that the judge overseeing the New York case overturn the jury's conviction.
The ruling in the Daniels case, which marks the first criminal conviction of a former U.S. president, was originally set to be announced on July 11, but Judge Juan Merchan postponed it, if still necessary, until September 18.
In the Florida case, Trump faces 31 counts related to "willful retention of national defense information," each punishable by up to 10 years in prison.
He also faces charges of conspiracy to obstruct justice and giving false statements.
Trump is accused of retaining secret documents, including files from the Pentagon and the Central Intelligence Agency (CIA), in an insecure manner at his Mar-a-Lago residence, and obstructing efforts to recover them.
Judge Cannon, appointed by Trump, has indefinitely postponed the case of the classified documents and has faced criticism from some legal experts for rulings that were seen as overly sympathetic to the former president.
Trump faces charges in Washington and Georgia of conspiring to overturn the 2020 election results. However, these two cases have become complicated due to the immunity ruling, and it seems unlikely that a trial will take place before the presidential election in November.
