Class action lawsuit in several Canadian provinces after multiple salmonella infections in cantaloupe fruit

A woman named "Michelle Lee Jani" from Ontario filed a lawsuit in King’s Bench Court in Manitoba, after falling ill from consuming cantaloupe fruit linked to Salmonella contamination across Canada. She is the lead plaintiff in the second class-action lawsuit. This lawsuit filed in Manitoba mentioned the Mexican company that grew the watermelon Malichit, as well as two American companies, Trufresh in Nogales, Arizona, and Dulcinea in Los Angeles. These two companies grew the fruit they sold in Canada and also imported the fruit.

The plaintiffs allege that the three companies failed to properly test the cantaloupe's safety before releasing it to markets and stores, which is against the law and violates consumer rights. The woman described her illness as suffering from abdominal cramps, diarrhea, and vomiting after consuming the Salmonella-infected cantaloupe. A document filed by Siskinds LLP, based in London, Ontario, indicated that the lawsuit has strategic reasons for being filed in Manitoba, although the company did not do so.

A class-action lawsuit regarding the contaminated cantaloupe was filed earlier in Quebec last December.

In British Columbia, the third lawsuit related to this matter is still pending.

On the other hand, the Canadian Public Health Agency reported that 7 people died due to Salmonella linked to consuming cantaloupe, and 164 people were confirmed by laboratory tests to be infected with the disease from eight Canadian provinces, including 111 cases from Quebec.
