Air Canada is appealing a decision made by the country's Transportation Regulatory Authority that seeks to improve accessibility for travelers with disabilities.

The measure raised before the Federal Court of Appeal aims to cancel the order from the Canadian Transportation Agency that requires the airline to accommodate passengers whose electric wheelchairs do not fit the cargo door on a scheduled flight.

The agency requested Air Canada to either find similar flights on a similar route or replace the aircraft with one on the route that can carry electric wheelchairs, provided the customer requests this three weeks in advance.

Air Canada's appeal of the aircraft replacement order continues in a case that has lasted more than seven years after passenger Tim Rose accused the airline of discrimination when he was told his electric wheelchair did not fit the plane in 2016, preventing him from boarding his flight to Ohio.

Rose also said this latest move is disappointing, especially after the airline welcomed new measures in November to improve the travel experience for travelers with disabilities.

Air Canada said it agreed to most of the orders to remove barriers, but it objects to the requirement to change aircraft within a short time frame for shorter routes.
