A father from Calgary warns of a "worrying" condition in the summer camp contract.

How confident are you in sending your children to daycare or summer camp?

A parent in Calgary is calling attention to what he terms a "deeply troubling" clause in the contract sent by staff at the Rundle College summer camp.

Chris Llewellyn said he was planning to send his 7-year-old son to the week-long camp this summer, until he read what he calls questionable details about the week-long camp contract.

He claims that the risk assessment form signed by parents completely releases the school from negligence liability or providing "reasonable care."

He explained, "I think it's ridiculous for them to accuse me of providing care for my child at camp when they say they don't have to provide reasonable care or any supervision."

Llewellyn said the form asks the signer to accept that "negligence may result in damage to participant property, physical injury, personal injury, and death."

This comes after one of the daycare centers in Fueling Brains, which was linked to an E. coli outbreak earlier this year, found itself in hot water for a similar reason. When parents received a code of conduct from the company, it included a section that seemingly absolved Fueling Brains of any negligence.

Chadwick Newcomb, from the Kahane Law Office, said such contracts are actually very common, and that is why parents should always read before they sign.

What we are talking about is the distribution of risk when leaving property or engaging in an activity; in some ways, it is no different than the waiver you would sign if you were at a trampoline park.

Newcomb pointed out that there are still some opportunities for recourse even though the forms absolve some liability.

He said, "There are certain legal requirements that apply in many of these cases." "For example, is the assumption of risk written in small print on the back of the form instead of being in larger or bolder print on the front of the form?"
