Protest organizer Tamara Leach was released on bail for the second time after a judge overturned a previous order that had sent her back to custody.
Leach said as she left the Ottawa courtroom on Tuesday, "I am very happy to be free."
She has been detained since June 27 on charges of breaching bail conditions. Supreme Court Judge Andrew Goodman said the judge who presided over Leach's June 27 hearing made several legal errors and misunderstood some facts when ordering her continued detention.
Leach was accused of violating a bail condition prohibiting her from contacting ten other protest organizers, including former Freedom Convoy spokesperson Tom Marazzo.
Goodman found the breach allegation "weak" and not "rationally connected" to the underlying idea of the no-contact order - to prevent organizing another Freedom Convoy protest.
He disagreed with the provincial court judge on the seriousness of the charges – a key factor in bail decisions – saying it was unlikely she would be sentenced to a long prison term if convicted.
Leach can be sentenced to up to 10 years in prison due to the protest's impact on the city and its citizens.
Leach’s defense lawyers said they are happy with the ruling. The lawyer said, "Obviously, we are disappointed that it took nearly a month in custody to get to this point, but we are happy today – it is clear that her detention was inappropriate, and this has now been corrected and she has been released."
