Filing a complaint against the Tim Hortons mobile app

Ottawa - The Canadian Privacy Commissioner will today present a report on the results of an investigation into whether the Tim Hortons mobile app tracks users' locations without their explicit consent.

This 23-month investigation came after National Post reporter James MacLeod obtained data showing that the Tim Hortons app on his phone tracked his location more than 2,700 times in less than five months.

The tracking occurred even when the app was not being used, despite the company's website stating that tracking would only happen while the app was open.

The investigation was conducted by Federal Privacy Commissioner Daniel Therrien in collaboration with privacy commissioners from British Columbia, Quebec, and Alberta.

The investigation is expected to determine whether Restaurant Brands International, the parent company of Tim Hortons, complies with Canadian national privacy law and obtains users' consent to collect and use their location data.

At the start of the investigation, the company's statement expressed confidence that the issue would be resolved and that the app had already been updated to ensure that location data is tracked only while using the app, regardless of the phone's specific settings.
